1. Agreement to Terms
By accessing or using the website theluxflora.com and placing an order with LuxFlora LLC (“LuxFlora,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions. These terms apply to all purchases made through our website or any other ordering method.
LuxFlora LLC reserves the right to modify or update these Terms & Conditions at any time without prior notice. Continued use of the website or placement of orders constitutes acceptance of any revised terms.
You must be at least eighteen (18) years of age or have the consent of a legal guardian to place an order.
2. Product Nature and Substitutions
All floral arrangements are created using fresh, seasonal flowers. Due to the natural and perishable nature of floral products, variations in color, size, shape, and composition may occur.
LuxFlora LLC reserves the right to substitute flowers, foliage, or containers of equal or greater value when necessary due to seasonal availability, market conditions, or supply limitations. Such substitutions shall maintain the overall style, color palette, and quality of the original arrangement.
3. Pricing and Payment
All prices are listed in United States dollars (USD). Full payment is required at the time the order is placed.
LuxFlora LLC reserves the right to correct pricing errors, modify product pricing, or cancel orders that contain incorrect pricing information.
4. Order Acceptance
Order confirmation does not constitute final acceptance. LuxFlora LLC reserves the right to refuse or cancel any order at its sole discretion, including but not limited to cases involving suspected fraud, incorrect pricing, or product unavailability.
5. Perishable Goods
All floral arrangements are perishable goods. Accordingly, all sales are final, except as expressly provided in the Refund & Cancellation Policy.
6. Delivery Responsibility
All deliveries are performed by a third-party courier service. LuxFlora LLC shall not be responsible for delays, damages, or losses caused by the courier once the arrangement has been released for delivery.
7. Limitation of Liability
To the fullest extent permitted by law, LuxFlora LLC shall not be liable for:
• Delivery delays caused by third-party couriers
• Weather conditions or force majeure events
• Incorrect or incomplete delivery information provided by the customer
• Any indirect, incidental, or consequential damages
In all cases, LuxFlora LLC’s total liability shall not exceed the purchase price of the product.
8. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

DELIVERY POLICY

1. Service Area
LuxFlora LLC provides delivery services exclusively within South Florida. Nationwide or international shipping is not available.
All deliveries are completed through a third-party courier service.
2. Delivery Schedule
Deliveries are available seven (7) days per week.
Customers may select a preferred delivery date at the time of checkout. Delivery times are estimates and are not guaranteed.
Standard delivery hours are between 9:00 AM and 7:00 PM.
3. Same-Day Delivery
Same-day delivery is available, subject to product availability, courier capacity, and order cutoff times.
LuxFlora LLC reserves the right to decline same-day delivery requests at its discretion.
4. Recipient Availability
If the recipient is not available at the delivery location, the courier may:
• Leave the arrangement in a safe location
• Leave the arrangement with a front desk, concierge, or neighbor
• Attempt redelivery, subject to additional fees
LuxFlora LLC shall not be responsible for the condition of the arrangement after delivery has been completed.
5. Incorrect Delivery Information
Customers are solely responsible for providing accurate and complete delivery details.
Additional fees may apply for:
• Address corrections
• Re-delivery attempts

REFUND & CANCELLATION POLICY

1. Perishable Nature of Goods
All floral arrangements sold by LuxFlora LLC are perishable goods. Accordingly, all sales are final.
2. Reporting Issues
If there is a problem with an order, the customer must contact LuxFlora LLC within twenty-four (24) hours of delivery.
Customers must provide:
• Order number
• Description of the issue
• Clear photographic evidence of the arrangement
LuxFlora LLC shall review each claim on a case-by-case basis and may, at its sole discretion, offer:
• A replacement arrangement
• Store credit
• A partial or full refund
3. Order Cancellations
Orders may be canceled or modified only if the arrangement has not yet entered production.
Same-day and next-day orders are non-cancelable.
If materials have already been purchased or preparation has begun, LuxFlora LLC reserves the right to charge a cancellation fee.
4. Non-Refundable Circumstances
Refunds shall not be issued for:
• Incorrect delivery information provided by the customer
• Recipient unavailability
• Delivery delays caused by the courier or external conditions
